TERMS & CONDITIONS FOR USAGE OF RED-e Bins
The Customer (which for the purpose of this Agreement includes its employees, servants & agents) hereby agrees to use Equipment based upon the following Terms & Conditions. By agreeing to use RED-e Bins Equipment, you agree to be bound by these Terms & Conditions which constitute a contract between you and RED-e Bins (ABN 76 002 889 867) of PO Box 480, Lake Cathie NSW 2445, Australia.
DELIVERY OF EQUIPMENT Delivery of Equipment to the Customer shall take place at the premises requested. The Customer agrees to not move the Equipment. The Customer acknowledges that at all times the ownership of the Equipment remains with RED-e Bins and the Customer will not remove any identification from the Equipment.

USAGE PERIOD The usage period commences on the Delivery Date shown on the Tax Invoice or Delivery Receipt and continues until the agreed date for pick up. If the Customer is not ready for the Equipment to be picked up on the date specified, then additional charges may accrue at the daily rate set out on the Tax Invoice / Delivery Receipt. No extra charges apply if RED-e Bins is unable to pick up the Equipment on the agreed date.

PAYMENT Payment shall be made by the Customer to RED-e Bins s on or prior to delivery via cash , cheque or credit card (Visa or Mastercard). Payment can be made to the driver at the time of delivery, credit card over the phone or in person at our offices (prior to delivery). The rates shown on the Tax Invoice do not include GST or other charges – these are shown separately.

OTHER CHARGES Please note, in instances where a Customer puts waste types other than that specified when getting a quote into the bin, additional dumping or disposal charges might apply. This is also true if a skip is filled beyond the stated maximum level, as indicated by signage on the bin.

CUSTOMER’S COVENANTS The Customer agrees with RED-e Bins that:
(i) the Customer shall permit RED-e Bins its agents or servants to enter the premises where Equipment is located at all reasonable times in order to access the Equipment and/or carry out repairs to the Equipment;

(ii) the Customer is responsible for the safekeeping of the Equipment and shall bear the risk of any loss, theft, damage or destruction of Equipment. The Customer shall keep the Equipment in a safe and proper location and shall adequately cover to avoid material being blown out or removed from the bin.

(iii) the Customer accepts full responsibility for the Equipment, including its use in accordance with any operating instructions provided or Local Council or Government Regulation(s) and will not alter or modify the Equipment;

(iv) the Customer accepts full responsibility for any injury to person(s) or damage to property belonging to the Customer or any other person arising out of the use of the Equipment, however such injury was caused.

INDEMNITY The Customer agrees to indemnify RED-e Bins against any liability for damages caused to any kerbing, driveway, pavement or other surfaces as a result of the use of the Equipment and its delivery or collection.

The Customer shall give prior notice regarding the existence of any underground services which may be damaged and shall indemnify RED-e Bins against any damages, whether or not adequate prior advice was given to the owner.

The Customer agrees to indemnify RED-e Bins and be responsible for all costs, charges and other liabilities incurred by RED-e Bins as a result of the Customer’s breach of any of these Terms and Conditions or as a result of RED-e Bins’ enforcement of any of them or arising out of or in any way connected with the use of the Equipment.

HAZARDOUS MATERIALS The Customer agrees that no asbestos-based materials or hazardous materials including tyres, liquids, chemicals or gas bottles will be placed in the Equipment provided by RED-e Bins.
No mechanical means will be used to compact the contents being placed in the equipment.

PICK UP / COLLECTION OF EQUIPMENT The Customer agrees to provide adequate access to the Equipment. If the Equipment is blocked or positioned to prohibit collection, any further attempts made for collection may be classified “extra service” and so duly charged.
